1. Acceptance of Terms

By creating an account and using Logger ("the Service"), you agree to these Terms of Service in their entirety. If you do not agree with any part of these terms, you may not use the Service. Glyphholm LLC ("we," "us," "our," or "Company") reserves the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

Logger is a web-based activity tracking and academic record management system designed for homeschooling families. The Service allows users to:

The Service is provided on an "as-is" basis with no guarantees regarding completeness, accuracy, or educational accreditation.

3. User Accounts and Eligibility

Account Creation: You are responsible for maintaining the confidentiality of your email and password. You agree to provide accurate, current, and complete information during registration.

Age and Eligibility: You must be at least 18 years old or the legal guardian of a minor to create an account. Parents/guardians are responsible for their children's data.

Account Responsibility: You are solely responsible for all activity under your account. You agree to notify us immediately of any unauthorized access or security breaches.

4. Free Trial

30-Day Trial: New accounts automatically receive a 30-day free trial upon registration. During the trial period, you have full access to all core features:

Trial Expiration: At the end of 30 days, your account will enter read-only mode unless you purchase a paid subscription. During read-only mode, you can view all your data and shared transcripts but cannot add, edit, or delete entries.

One Trial Per User: Only one free trial is offered per unique email address. Creating multiple accounts to access additional trials violates these terms.

5. Paid Subscriptions

Pricing: Subscription pricing is displayed on our website and in-app. We reserve the right to change pricing with 30 days' notice.

Billing: Subscriptions are billed monthly on the date you purchase. You are responsible for keeping your payment method current.

Payment Processing: We use Stripe for payment processing. By providing payment information, you authorize us to charge your payment method for the subscription price plus any applicable taxes.

Refunds: Subscription fees are non-refundable except as required by law. If you cancel a subscription, you will have access through the end of the current billing period.

Cancellation: You can cancel your subscription at any time through your Settings. Cancellation takes effect at the end of your current billing period.

6. Data and Content

Your Data: You retain all rights to data you provide (activity logs, child information, notes, etc.). You grant us a license to store, process, and display this data to provide the Service.

Shared Transcripts: If you generate a shareable transcript link, anyone with the link can view that transcript without logging in. Shared links remain active even after your trial expires or subscription ends, until you explicitly delete them.

Backup and Recovery: We maintain automated daily backups of user data with 30-day retention. In the event of data loss, we will restore from the most recent available backup.

Data Export: You can export your data to CSV format at any time. The exported data is yours to use.

8. Maintenance and System Testing

Scheduled Maintenance: Logger may require periodic maintenance, updates, and improvements. We will:

Automated System Testing: To ensure quality and reliability, Logger runs automated system tests regularly, typically during off-hours. These tests:

No Data Loss: Automated testing and maintenance activities do NOT access, modify, or delete your personal data. Test accounts and data are separate and isolated from your account. Your data is not affected by testing or maintenance activities.

Service Level: While we aim for 99.5% uptime, Logger is a service that may experience temporary unavailability. We reserve the right to update software with little notice if critical security issues arise.

9. Limitation of Liability

As-Is Service: The Service is provided "as-is" without warranties of any kind, either express or implied. We make no guarantee regarding:

Educational Use: Logger is a data management tool and does not provide educational curriculum, instruction, or accreditation. You are responsible for educational content and compliance with state requirements.

No Liability for Indirect Damages: In no event shall Glyphholm be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

Maximum Liability: Our total liability to you shall not exceed the amount you paid for the Service in the past 12 months, or $100, whichever is greater.

10. Intellectual Property

Service IP: All materials, features, and functionality of Logger are owned by Glyphholm LLC and protected by copyright, trademark, and other laws.

License Grant: We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal use only.

Your Content: You retain all intellectual property rights to content you provide. By using the Service, you grant us permission to store and display your content as necessary to provide the Service.

11. Third-Party Services

Logger integrates with third-party services:

12. Student Photos

User Representation: You represent that you have the legal right to upload any student photos (e.g., parent/guardian of depicted student) and that the photos are appropriate for educational use.

Content Restrictions: You may not upload photos that are offensive, illegal, or violate others' privacy or rights.

Ownership and License: You retain all ownership rights to photos you upload. You grant Glyphholm a limited license to store and display the photos within your account only.

No Public Sharing: Student photos are never shared publicly or with third parties. They appear only on Student ID cards and reports visible within your account.

Admin Deletion: Glyphholm may delete any photo that violates this policy or applicable laws without advance notice.

User Deletion: You can delete any photo at any time from the Student ID tab.

13. Termination

Account Deletion: You can request account deletion at any time through Settings. Account deletion is a two-step process requiring confirmation.

Data Deletion: Upon deletion, we will remove all your personal data (activity logs, child information, etc.) from our servers within 30 days. Shared transcript links will be deactivated.

Company Termination: We may terminate your account if you violate these terms or for any reason with 30 days' notice. Upon termination, we will provide your data in export format before deletion.

14. Privacy and Data Protection

Your privacy is important to us. Please see our separate Privacy Policy for details about how we collect, use, and protect your data.

15. Changes to Terms

We may modify these terms at any time. Changes become effective immediately upon posting. Your continued use of the Service constitutes acceptance of modified terms. We will provide notice of material changes via email if they significantly affect your rights.

17. Governing Law

These Terms of Service are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any legal action or proceeding related to the Service shall be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining terms shall remain in full effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Glyphholm regarding the Service and supersede all prior agreements and understandings.
